1. Scope
1.1 These Terms and Conditions of AIP-enjoy GmbH (“Seller”) apply to all contracts concluded by a consumer (“Buyer”) with the Seller regarding the goods and/or services displayed on www.hanfstecklinge.net.
1.2 A consumer within the meaning of these T&Cs is any natural person who enters into a legal transaction for purposes that predominantly are outside their trade, business or profession.
1.3 You must be at least 18 years old to purchase from us.
1.4 By purchasing, you undertake not to misuse the goods acquired from us for unlawful activities. Please observe the laws applicable in your country.
2. Conclusion of Contract
2.1 The conclusion of a contract via www.hanfstecklinge.net is governed by the Austrian Distance and Off-Premises Transactions Act (FAGG).
2.2 The presentation of products in the online shop does not constitute a binding offer.
2.3 By placing an order via the “Order” button, the Buyer submits a binding offer.
3. Right of Withdrawal
3.1 The Buyer is entitled to withdraw from the purchase within 14 days after receiving the goods.
3.2 Return shipping costs are borne by the Buyer.
3.3 The right of withdrawal under § 11 FAGG does not apply to the following products: cannabis clones, seedlings, seeds, used/damaged goods, living beneficial organisms. As seeds are natural plant products, we cannot guarantee germination.
3.4 The right of withdrawal does not apply to consumers who, at the time of contract conclusion, are not residents of an EU member state and whose sole residence and delivery address are outside the EU.
4. Prices and Shipping Costs
4.1 All prices include statutory VAT plus shipping costs.
4.2 Information on shipping costs can be found in the shipping cost table.
4.3 As shipping conditions are beyond our control, the shipment of live products such as beneficials, cannabis plants and seeds is made without any warranty.
5. Delivery and Payment Terms
5.1 Unless expressly requested by the Buyer, goods are shipped uninsured. Upon delivery, the Buyer must inspect the goods and immediately report visible damage to the courier or refuse acceptance.
5.2 Delivery is made to the address provided by the Buyer. We ship via Hermes, GLS or Post and therefore cannot influence delivery times. You will be notified as soon as your order leaves our shop.
5.3 Claims for damages due to delay, impossibility or non-performance, including those arising up to the point of withdrawal from the contract, are excluded.
5.4 Payment is possible via advance bank transfer (see payment options). Due to high commission fees, we do not accept credit cards.
5.5 For natural products such as cannabis plants and seedlings, we reserve a processing time of up to 3 weeks from receipt of payment. In most cases, shipping will be faster.
6. Retention of Title
6.1 Title to the delivered goods remains with AIP-enjoy GmbH until full payment of the purchase price has been received.
7. Applicable Law
7.1 Place of performance is the registered office of AIP-enjoy GmbH, Jedleseer Straße 67, 1210 Vienna, Austria.
7.2 The place of jurisdiction is the Commercial Court of Vienna.
7.3 Should any provision be or become invalid or conflict with applicable law, the remaining provisions shall remain effective. The invalid provision shall be replaced by a valid one that most closely reflects its economic intent.
8. Incorrect Address and Phone Number Details
8.1 AIP-enjoy GmbH assumes no responsibility for deliveries that cannot be completed due to incorrect or incomplete address and/or phone number details provided by the customer.
8.2 The customer is obliged to provide accurate and complete address and phone number details when ordering. The customer bears sole responsibility for delivery delays or non-delivery due to inaccurate or incomplete information.
8.3 If shipments must be returned due to incorrect address or phone number details, the customer shall bear all associated costs, including return fees and additional shipping costs for reshipment.
8.4 A valid e-mail address is required for order processing and communication. AIP-enjoy GmbH assumes no responsibility for delays or misunderstandings due to incorrect or non-functional e-mail addresses.
